Monday a viewer called News 4 to complain of a downtown Reno business flying the Mexican flag above an American flag.

This, after photos and comments about the flag were posted on Craigslist this morning. When we were able to have a photographer go and check everything out we found the story to be true.
It also didn t take long before the situation provoked a strong reaction. If you click on the video link in this story we will show you , unedited, what happened.

Responding to a controversy over a Mexican flag flying at a local bar, Reno police and the ACLU issued statements today emphasizing it is not illegal to fly another flag above the American flag.
I find it interesting that numerous state law enforcement agencies hide their head in the sand when it come to enforcing federal illegal immigration laws while on the other hand you are quick to cite federal regulation when it benefits Mexicans who go out of their way to affront American citizens by disrespecting designated protocol for display of our United States flag. Isn't it against the law to taunt people?
Are you going tell me that I can use my freedom of expression; freedom of speech to go out into the public and taunt people and you won't take any action against me just as you failed to do so with the Mexican establishment that degraded the American flag?
I serious doubt it. The first thing you will do when you observe me taunting someone in public will be to have a serious talk with me. and threaten me with legal action if I do not stop. On any given day, I cannot turn on a news station without seeing the news of a police department somewhere throughout these United States refusing to enforce federal immigration laws rather; you come up with excuses why you cannot get involved.
Its no wonder American citizens are getting pissed in this country. Politicians and local police are too busy protecting illegal aliens instead of American citizens who pay your salaries. Here's a radical thought...try protecting American citizens with the same zeal and equal protection you afford illegal aliens and/or Mexican nationals who taunt American Citizens.
Your local politicians and police are partly to blame for allowing this situation to escalate out of control. Common sense should have told you that allowing the national flag of our country to be displayed inferior to another nation's flag while on American soil was both insulting to, and taunting Reno citizens at the same time.
You lack of attention to this explosive situation suggests a lot of you could use sensitivity training. You should have anticipate the potential for trouble well in advance but didn't. How pitiful that your political correctness attitudes to cower to the Mexican community (how many are illegal) drew in the emotions of an ex-U.S. Army service man who felt he had no choice but to demonstrate his patriotic sense of duty to have take the action he did.
After all, politicians and police were going to be politically correct and sensitive to the Mexican establishment owners and to hell with their taunting of the public.
So now, the Soviet Socialist State of NV along with it Socialist Commandos, the ACLU, want to prosecute the U.S. army vet for exercising his First Amendment which protects every American's right to speak and express themselves, Reno city counsel has the authority to enact an ordinance if not already on the books that would deescalate these types of situations but, the question is, did they and will they?
It should have been taken care of a long time ago. Reno, NV your city is an embarrassment to American citizens.

I beg to differ with anyone who makes this a religous argument or comment that ignorance is involved in this issue, this is one of politics, and pride.
My opinion is that if Hispanics would go through the process of becoming legal citizens they would understand and maybe apperciate what our flag and what our forefathers have fought and continue to fight for, we fight for freedoms that allow you to fly the Mexican flag, but not above ours! This is America and we all need to respect that. I wouldn't go to Mexico and do that!
PS - In Pahrump NV you will be fined if you fly a Mexican flag period, included is an aritcle "The resolution requires all government business to be conducted in English, and denies town "benefits" (of which none currently exist, since they informally declared emergency services not a "benefit") to be given to illegal immigrants.
The resolution denies private residences and businesses the right to fly alone the flag of a nation other than the United States."

Most of us by now have learned that it is, in fact, not illegal to disgrace our flag in the manner reported. However well-intentioned Jim Brossard was, it was an illegal act on his part to remove the flag.
While I salute his patriotism and totally understand his motivation, I cannot condone his action. I would love to see patriotic Americans show their 1st Amendment rights by totally boycotting/protesting the involved business.
The owner knew he would be stirring the pot when he did what he did, let this (blockade) be his reward. ACLU get a life.

I am disappointed at the reactions reflected here in these comments. I'm confident Jesus would have acted with more civility by asking the owner to correct the situation without a confrontation.

Regarding "Flag of Mexico Flown Illegally Over Reno Business", things like this are starting to happen here in New York state.
Governor Spitzer wants illegal aliens to be able to get driving licenses without regard to their legal/illegal status.
HELP! Those of us who have to put up with all of the government bureaucracies for all of these years to keep us legal will not pertain to illegal aliens?
This is discrimination against US citizens and giving preferencial treatment to outsiders who are not supposed to be here (unless obtaining legal status).
Also, the strain will be on "legal", overburdened taxpayers to cover those who are illegal. Where will this all end? The disadvantages outweigh the advantages here.

I saw the news this morning and I congratulate you on showing a video of a vet tearing down the Mexican flag as it hung over the U.S. flag at a local business.
The law is the law. We all have to abide by it. It's about time someone took a stand.
Maybe we should picket at the courthouse and voice our displeasure over the ways things are going. We have to be politically correct and not offend anyone and yet we are stepped on and expected to do nothing.

The gentlemen who took down the mexican flag should be honored for his patriotism and protecting our flag which was being used illegally. The owner of the bar who claims to be a citizen prefers mexico to America by his actions.
Maybe he needs to have his status checked and if here illegally, deported. Then your followup story had to do with more mexicans protesting.

While I originally applauded the citizen and veteran of our military for correcting the flag issue in Reno yesterday, I am concerned about the impression of vigilante-ism the act will have on our society in general.
While a law was broken and needed to be corrected, I believe a less forceful means may have helped to build a bridge of understanding rather than the forceful act of destruction of private property that was exacted.
Perhaps a boycott and picketing of the establishment would have impacted this business owners operation, or a verbal discussion of the fact that he had broken the law would have been better.
Regardless of the owners intention, if individual citizens start taking law enforcement into their own hands, the brave men and women we expect to be the thin blue line between us and anarchy could be caught in the middle of an eventual firestorm.

I support the veteran who removed the American flag with his knife.
They don't deserve to get it back after illegally placing the Mexican flag above ours. If charges are brought against the veteran for theft, I anticipate a firestorm of protest.

This vet obviously isn't concerned about freedom for all, only freedom for those who agree with his opinions. The fifth amendment isn't just to protect the speech that you personally agree with. If unpopular speech is not protected then there is no freedom of speech; popular speech doesn't need protection. If this vet truly understood the freedoms granted by the constitution and was concerned with upholding them, he wouldn't have done that. He is showing his ignorance, arrogance, and/or racism by acting like that. He was armed with a weapon and threatening violence. His behavior is certainly nothing to be proud of.

What is your story comment for News 4?: Speaking as a veteran myself I found nothing heroic in the manner by which the flag was removed. While I was still on active duty it was common for our own soldiers to often improperly hang our flag up in front of their own off-base homes.
Why is it assumed this merchant meant to be disrespectful? People are not taught how to properly display a flag in this country. And by "people" I mean all of us. I applaud the resturant's owner for even displaying the American flag. It is not a common site in this country for small businesses to display a flag. The proper, American, thing to do would have been to attempt to maturely correct the situation by informing the merchant as to the proper etiquette for displaying the flag. I'm sure after watching a "veteran" cut down both the American flag and flag of his motherland, the latter thrown to the ground in disrespect, he won't be so apt to display the American flag in the future.

In contradiction to what someone stated earlier, while it is illegal for this verteran to have taken their flag, it is also illegal to fly any flag above the US flag within our borders (see US Flag Code link in the story).
I am all for honoring one's heritage and roots, but what used to be the "melting pot" where different backgrounds added to an American identity has become a divide nation set on being something else first and an American citizen last. Our country used to have pride and the drive of millions of individuals to be a great nation. Now we are a nation with the drive to be great individuals and our pride, glory, and identity are slowing fading into the sunset.
We wonder how we have fallen behind so many other countries and how other nations look on us with contempt now. Well, the truth lies in the lack of unity and respect we have for each other as fellow Americans. If we want to be the great nation we once were we need to start standing strong together as Americans. As the story behind the National Anthem states (if you haven't heard/read this story I urge you to do so), this country was founded on the sacrifice and effort of men and women who would rather face certain death than let the entire nation fall. (c) No other flag or pennant should be placed above or, if on the same level, to the right of the flag of the United States of America, except during church services conducted by naval chaplains at sea, when the church pennant may be flown above the flag during church services for the personnel of the Navy. No person shall display the flag of the United Nations or any other national or international flag equal, above, or in a position of superior prominence or honor to, or in place of, the flag of the United States at any place within the United States or any Territory or possession thereof:
That is the final word on the flag flying above the US Flag. Federal Law overrides any local issue concerning the US Flag.

To those who think that vet was wrong, why don't you ask a vet what flag means to them before you condemn him. It seems to me that too many Americans may have forgotten what that flag means to us as an individual, a country and to the world. Mexican Flag flying over USA flag being cut down by vet...GOOD FOR HIM. It is TREASON to fly the flag of another country above our own. You are in our country and must show the proper respect as such. f someone WANTS to live in the US, they MUST come legally, become legal resident/citizen, and put the US before their OLD country, which is not to say that they can't honor this country, but it HAS to be subservient to their NEW allegiance here.

Large scale immigration, legal or illegal, is putting huge stresses on our governments to upkeep and increase our infrastructure to accommodate all of these new people, and the "taxes" paid by these people DO NOT come close to paying the costs of these repairs/upgrades and the money sent out of our country to the "home" country of most of these people which has been quoted by federal agencies and news concerns as in the BILLIONS! While they get free, to them at least, health care, food assistance, schooling and other government assistance at a very minimal cost to them. Where the "Legal" citizen/residents are paying more than their share of money, primarily the middle class citizen who on one hand is considered poor, but when that doesn't fit into the economical/political reality, they are called "rich". I am NOT condoning increasing Taxes on the Rich or anyone, but we must have Responsible growth and those who say we need to increase our immigration/visa quota, they must be made to understand that it is just going to make things worse for those here already.

Several people have claimed that flying another flag above the United States flag is a violation of federal law. Unless you are in the military or another agency of the government, this is not true. The Federal Flag Clode (4 U.S.C. §§ 4-10) is not binding on private citizens or private businesses. It contains no enforcement section and no penalties, and explicitly states that its purpose is to establish a set of VOLUNTARY GUIDELINES: "The following codification of existing rules and customs pertaining to the display and use of the flag of the United States of America is established for the use of such civilians or civilian groups or organizations as may not be required to conform with regulations promulgated by one or more executive departments of the Government of the United States."
As for those who claim that this two-bit thug has some kind of First Amendment right not to be prosecuted need to think harder. Freedom of speech does not protect your right to grab a knife and destroy other people's private property. If you don't like how a private business treats the U.S. flag, you should feel free not to patronize that business. But you have absolutely no moral or legal right to deface or steal someone else's property in order to get your way.

Inregards to th eMexican Flag being flown over the US flag. I dont believe its a racism issue it just so happen that A MEXIACN flag was being flown over a US Flag. I could have been any flag and I know that VETETRAN would of done the same thing. People who bring up racism at these type of incidents are contributers to RACISM period. Bottom line... I think he did the right thing. I don't see any thing wrong with Mexicans going back to Mexico, and flying the American flag there though. They just don't understand how to be proud of there flag till they get to AMERICA. I don't expect they will ever have the guts to go back and make there country free. Mexico uses the U.S. as there jail. I havn't heard of any rocket scientists crawling across the border. How dose this guy run a business or diserve to in the U.S. ?

I am commenting about the Vet who took down the Mexican Flag and took with him the US Flag. I am proud of him! We need more people like the VETS who LOVE their flag, the flag they shed blood for. Our country needs to remember the red upon the flag stands for the blood shed for our country and our freedom. Our country is NOT Mexico. Respect our flag, or get out. If you can get word to that Vet, tell him, there are people here in Maryland who are proud of him and his service to our country.

I want to say thank you to Jim for taking the action to stop those people from degrading our country. I would love to meet him in person or at least talk to him to tell him a BIG THANK YOU from our family. Those mexicans need to know that if they want to fly a flag as high as the American Flag they need to come to Texas but the only flag they will be flying at that height is the Texas flag... Mr. Jim if you read this I truly thank you from the bottom of my heart for defending this country. They are over here in America they need to act like they are in America. Respect our country you wanted to come here for a reason and we gave you what you came here for now show some freaking respect. Jim if I ever meet you I will cook a down home American meal for you. If you and your family are ever in Texas look me up.
